Motion on 16th amendment verdict placed in JS

Dhaka, Sept 13 (UNB) – Jasod MP Moin Uddin Khan Badal on Wednesday placed a motion in Parliament demanding proper legal steps for scrapping the Supreme Court’s declaration of the 16th amendment to the Constitution as ‘ultra vires’ and removing unconstitutional, objectionable and irrelevant observations of the Chief Justice in the verdict.

He raised the motion in the House under the provision 147 (1) of the Rules of Procedure at 6:03pm when Speaker Dr Shirin Sharmin Chaudhury was in the chair.

Immediate after the placement of the resolution, a general discussion started on it in the House. 

The motion reads, “Proper legal steps should be taken for revoking the SC’s declaration of the 16th amendment to the Constitution as ‘ultra vires’ and unconstitutional, objectionable and irrelevant observations of the Chief Justice in the verdict.”

In the motion, Badal said Chief Justice Surendra Kumar Sinha termed MPs ‘immature’ alongside making unnecessary and unwarranted remarks regarding many irrelevant issues in his observations in the verdict. “A huge debate continued over it, which is not expected for the nation,” he added.

“This parliament wants an end to the present situation through massive discussion so that attempts of any evil anti-people force to catch fish in troubled waters are thwarted,” he said.

The Jasod MP said he believes that the ‘fabric of democracy’ has been created with the coordination among parliament, the judiciary and the executive where newspapers contributed a lot.
