Chamber Judge of the Appellate Division Justice Hasan Foez Siddique passed the order dismissing a state plea seeking a stay on the HC order.
On August 28, the HC bench of Justice Md Emdadul Huq and Justice Kazi Md Ejarul Haque Akondo granted bail to Mitu.
Akash, 33, killed himself in Chandgaon residential area of the port city of Chattogram in the early hours of February 1 last after an altercation with his wife Mitu about her alleged illicit affairs.
On the same day, police arrested Mitu over the suicide.
Family members said before his apparent suicide, Akash had shared photos of his wife on his Facebook profile and wrote about her alleged extramarital affairs before announcing his decision to end own life.
Akash's mother Jobeda Khanam filed a case with Chandgaon Police Station accusing Mitu, Mitu's father Anisul Haque Chowdhury and mother Shamim Shelly, sister Sanzila Haque Chowdhury, her alleged boyfriends Mahbubul Haque and Indian citizen Uttam Patel.
