Supreme Court lawyer Advocate Taherul Islam Tawhid filed the writ which might come up for hearing at the bench of Justice Moyeenul Islam Chowdhury and Justice Md Ashraful Kamal this week, said petitioner’s lawyer Barrister Mahbub Uddin Khokon.
The Speaker, Chief Election Commissioner and Cabinet Secretary have been made respondents to the writ which sought court’s directives to issue gazette after
Khokon, also secretary of Supreme Court Bar Association, said the writ petition was filed as a legal notice issued on January 8 in this regard went unheeded.
As per the writ, the Speaker administered oath to the new MPs on January 3 following publication of a gazette which is the violation of section 123(3) of the constitution as they were sworn in before the expiry of the 10th parliament.
The five-year tenure of the 10th parliament was supposed to end on January 28.
